Venice Commission Issues Recommendations on Reform of Ukraine's Judicial Selection
The Venice Commission, the Council of Europe's advisory body on constitutional matters, published an opinion on September 25 on Ukraine's procedures for judicial selection and evaluation of judges. The Commission called for stronger guarantees to ensure that political influence is minimised in judicial appointments.
Key Recommendations
The Venice Commission's opinion highlighted the need for transparent, merit-based processes for the selection of judges to Ukraine's Supreme Court and lower courts. It recommended improvements to the role and composition of the High Qualification Commission of Judges, an independent body responsible for evaluating candidates.
The Commission also stressed the importance of protecting judges from political pressure once appointed, calling for stronger tenure and dismissal safeguards.
EU Accession Context
Judicial reform is one of the key benchmarks Ukraine must meet as part of its EU accession process. The European Commission regularly monitors Ukraine's progress on rule of law reforms, and addressing concerns raised by the Venice Commission is considered essential for Ukraine to advance on its path toward EU membership.
